Newly enacted Indiana farm maps go too far!

• 80% of the new DNR maps cover Indiana’s farmland and control any change in the surface of private property.

• Any work that disturbs or changes the grade of the earth within the floodplain requires a permit.

• Permit approval process can take 4 months and often 30-40 hours to complete the application process per permit.

• Millions of dead ash trees are now falling in areas designated as floodway and may require state permits to remove.

• Long time county legal drains are now prohibited from being maintained unless there is state approval.

• County drainage board authority often requires state approval.

Indiana Farmers & Rural Property Owners Seek Relief from Indiana WOTUS Like State Flood Maps.

In 2020, new DNR maps were sent to counties without notice to affected property owners. This affected 1,000’s of existing rural homes and estimated 1 million acres that were restricted or made impractical for most improvements. It was found that several entire rural communities were effected, decreasing property valuations.

Farm owners also found that the new DNR expanded map caused more conservation and stewardship practices requiring costly state permits and typical four month delays. Stewardship practices such as farm fence, ditch maintenance, stump removal and imbedded tree limbs require permits. This included areas a considerable distance from any water. It was found this Indiana Policy is more restrictive and unlike all surrounding states that exempt Ag conservation practices.

“WOTUS” is Water of the U. S. federal law that has been contested for years, but does not prohibit farm fence, stump or imbedded trees like Indiana.

2022 Indiana Legislature adopted Senate Bill 85 creating a Governor Task Force to research Indiana farm drainage law. Grass roots group, Friends and Supporters of Indiana Ag was formed to support the 2024 Indiana Legislation exempting agriculture conservation and stewardship from permitting and fees. The group is proposing Illinois and Ohio drainage law as examples.
